Perplexity's AI Shopping Features Cleared to Operate

A significant legal victory for Perplexity has emerged from a recent federal appeals court ruling, allowing the company's AI shopping features on Amazon to continue functioning. This ruling is pivotal in the ongoing discourse surrounding the interactions between autonomous AI agents and e-commerce platforms.

The Ninth Circuit Court of Appeals determined that Amazon's claims against Perplexity under the Computer Fraud and Abuse Act (CFAA) were unlikely to succeed. The court emphasized that it was the users accessing Amazon through the AI agent, known as Comet, and not Perplexity itself, that were potentially breaching any laws.

The CFAA requires a plaintiff to prove that a defendant intentionally accessed a computer without authorization or exceeded authorized access, resulting in a loss of at least $5,000 within a year. The court concluded that the users were effectively in control, utilizing their stored credentials to access the platform.

This legal battle began last November when Amazon issued a cease-and-desist letter to Perplexity, accusing the company of misrepresenting automated traffic as regular browsing and accessing user accounts without consent. Perplexity countered that Comet operated with user permission, highlighting Amazon's attempt to restrict consumer choice in AI technologies.

In a preliminary ruling earlier this year, a federal judge had temporarily halted Comet's capabilities on Amazon, suggesting that Amazon presented substantial evidence of potential violations. However, this latest appeals court ruling provides valuable insight into how courts may view the actions of AI agents operating on behalf of users, setting a precedent for future cases in the realm of autonomous AI and online commerce.
