Growing Resistance to Tokenized Stocks

Intel, Oracle, IBM, and IonQ have recently added their names to the list of companies opposing the trading of their shares on the OKX-ICE Tokenized Stock Venue (TSV). As of October 26, the total number of objecting issuers has surged to 26, a significant increase from just nine on October 15.

The joint venture, which combines the resources of NYSE owner Intercontinental Exchange and OKX’s U.S. holding company, aims to facilitate 24/7 trading of tokenized U.S. stocks. However, the reasons for these objections remain unclear, leaving investors uncertain about the implications for stock trading on the platform.

Rapid Increase in Opposition

The number of companies expressing objections has nearly tripled in less than two weeks. The most recent additions include notable firms from the tech sector, such as Microsoft, Alphabet, and Qualcomm, alongside financial institutions like Goldman Sachs and Wells Fargo. The latest notice did not clarify the potential impact of these objections on the trading of stocks on the platform.

Key Risks Highlighted

One significant concern raised in the notice pertains to investor protection. It remains uncertain whether tokenized shares stored in self-custodied wallets would be deemed customer property or covered by the Securities Investor Protection Corporation (SIPC) in the event of a broker-dealer failure. This uncertainty raises questions about the safety of investments in tokenized stocks.

OKXICE TSV intends to allow trading through Uniswap v4 liquidity pools on OKX’s XLayer blockchain, requiring users to meet identity and sanctions checks and to possess a nontransferable “soulbound” token. Trades must be fully funded, with no margin or borrowing permitted, and liquidity providers can withdraw their funds at any time.

The platform's operation under the SEC's innovation exemption, introduced in September, adds another layer of complexity to the situation, as the regulatory landscape continues to evolve.
