NBA Forms Partnership with CFTC
The NBA has officially partnered with the Commodity Futures Trading Commission (CFTC) to bolster the integrity of professional basketball amid the rising trend of prediction markets. This agreement marks the league's commitment to maintaining fair play as betting on sports increasingly shifts to federally regulated platforms.
Under the memorandum of understanding signed on Monday, both the NBA and the CFTC will collaborate to share information and monitor for potential abuses, including insider trading and fraud. This initiative aligns the NBA with other major sports leagues like MLB and NHL, which have also established similar agreements with the CFTC.
Context of the Agreement
The move comes as the CFTC seeks to classify event contracts, used in prediction markets, as “swaps.” This classification is part of an ongoing jurisdictional debate between federal and state authorities regarding the regulation of such markets. Meanwhile, the NFL is embroiled in a legal battle with Kalshi, a prediction market platform, which has drawn the attention of the Supreme Court. The NFL has yet to enter into a similar partnership with the CFTC, highlighting a contrasting stance among the leagues.
