Utah Takes Legal Action Against Kalshi

Utah has initiated felony charges against the prediction market platform Kalshi and its co-founders, Tarek Mansour and Luana Lopes Lara, alleging illegal gambling promotion within the state. The charges stem from an undercover operation where a state agent placed 12 bets on Kalshi in September, despite a federal ruling affirming that Utah's gambling laws are applicable to the platform.

The state’s Attorney General, Derek Brown, emphasized that gambling is prohibited in Utah, stating, "Calling it a 'prediction market' doesn't change what it is." Kalshi faces serious allegations, including one count of a pattern of unlawful activity, 12 counts of online gambling promotion, and one count of gambling promotion, with the latter two being felonies.

Kalshi's Response

In response, Kalshi criticized the charges as a "crazy overreach" and expressed intent to contest them in court, drawing parallels to a previous legal victory in Arizona. The platform argues that its federal registration should exempt it from state gambling laws.

Broader Legal Context

This incident is part of a larger dispute involving the Commodity Futures Trading Commission (CFTC), which has also filed a lawsuit against Utah to prevent the enforcement of its gambling laws against federally regulated exchanges like Kalshi. The CFTC argues that it has exclusive authority over such markets, a stance supported by federal officials, including former President Donald Trump.

Legal interpretations on whether states can impose gambling regulations on prediction markets have varied across federal appeals courts, leading to an increasing likelihood of a Supreme Court review in the future. The ongoing conflict raises significant questions about the intersection of state and federal regulatory powers in the gambling sector.
