The U.S. Securities and Exchange Commission (SEC) is gearing up to introduce its inaugural formal rule aimed at establishing clearer regulations for cryptocurrency businesses, specifically through "Regulation Crypto."
Chairman Paul Atkins has prioritized this rulemaking as a key aspect of his regulatory framework for crypto, and the SEC has scheduled a meeting for August 14, where the commission's three Republican members will present the proposed rule for public feedback. The agency issued a notice on Monday evening about the upcoming meeting, which has been on its agenda for some time, albeit with short notice.
The initiation of the Reg Crypto approval process is designed to create a structured offering regime for particular investment contracts, coming on the heels of last week's Senate inaction regarding the Digital Asset Market Clarity Act, which sought to establish a legal basis for crypto regulations in the U.S.
According to TD Cowen analyst Jaret Seiberg, this proposal is anticipated to be the first in a series of regulatory actions aimed at providing clarity for crypto assets, especially following the Senate's failure to advance the Clarity Act before their summer break.
The proposed regulation will likely enable crypto firms to secure funding for their projects without the need for SEC registration and may also offer a pathway for companies to disengage from the SEC's jurisdiction when they are no longer actively managing their projects.
Prior to this, Atkins and the SEC had released a series of statements outlining their stance on crypto policies, but those statements lack the permanence of formal rules. A structured rulemaking process would be more resilient to future changes.
However, the finalization of this rule may take several months, as the initial phase will include a comment period typically lasting two to three months, followed by a potentially extensive revision process.
Reg Crypto will complement other significant regulatory efforts by the SEC, including a collaborative approach with the Commodity Futures Trading Commission to define various cryptocurrencies and their respective regulatory jurisdictions. The SEC is also continuing to develop its framework for tokenized securities, a key initiative frequently highlighted by Atkins.
Atkins has emphasized the necessity of having Congressional legislation to establish clear guidelines for the crypto market, but lawmakers have not yet succeeded in moving forward with the bill, which may have a slim chance of progressing next month.
