Michigan Court Halts Kalshi’s Betting Operations

The Ingham County Circuit Court has ordered Kalshi to suspend its sports betting activities within Michigan, imposing a hefty daily fine of $500,000 for non-compliance. This preliminary injunction, signed by Judge Rosemarie Aquilina on Tuesday, arises from concerns over the platform's failure to implement necessary geolocation services to restrict access to Michigan residents.

Judge Aquilina highlighted the potential risk to vulnerable residents, characterizing Kalshi's operations as a deceptive form of sports betting disguised as investment opportunities. As part of the ruling, Kalshi is prohibited from advertising, funding accounts, or providing any services akin to sports betting until a final decision is rendered in the case.

Compliance Requirements

Kalshi must engage a licensed third-party geolocation provider that adheres to the Michigan Gaming Control Board's standards. Additionally, the company has three business days to notify futures commission merchants that offer its sports contracts about the injunction and to share Michigan's legal representatives' contact information.

Michigan Attorney General Dana Nessel has been actively pursuing legal action against Kalshi since March, based on the claim that the platform allows residents to place bets under the guise of trading event contracts. The recent ruling follows a series of legal challenges faced by Kalshi, including a previous restraining order issued in June.

Nessel has emphasized that the injunction aims to safeguard Michigan residents from what she describes as Kalshi's unregulated and predatory practices. This ruling adds to the regulatory scrutiny Kalshi has faced, particularly after similar actions taken by the Commodity Futures Trading Commission (CFTC) in other states to regulate betting practices.

The injunction will remain in place pending further legal proceedings, marking a significant setback for Kalshi in its operations within the state.
