Summary
- A Michigan judge has issued a 14-day ban on Kalshi's sports prediction markets.
- The ruling cites potential irreparable harm to young users while the case is ongoing.
- This decision is part of a larger national debate regarding the legality of prediction markets as gambling.
Kalshi has restricted access to its sports betting services for users in Michigan following a significant legal decision against the platform in the state court.
On Monday, a circuit court judge in Ingham County granted a temporary restraining order that prevents Kalshi from operating sports markets in Michigan for a period of 14 days.
This ban was initiated by state regulators amid an ongoing dispute regarding the regulatory status of prediction markets, which regulators claim are illegal gambling ventures. Meanwhile, Kalshi, supported by the Trump administration, maintains that these markets are swaps overseen federally by the CFTC.
In her decision to approve the temporary restraining order, Judge Rosemarie Aquilina concluded that allowing Kalshi to continue its sports prediction markets would cause the state irreparable harm as the case unfolded. She stated, “Michigan and its most vulnerable citizens are suffering and will continue to suffer immediate and irreparable harm absent relief from being exploited by Kalshi's sports betting operation masquerading as an investment opportunity.”
Aquilina expressed concern that the platform, by allowing users as young as 18 to engage in prediction markets, could significantly harm Michigan's youth and exploit critical mental health challenges without the necessary safeguards of licensed gambling entities.
As of Tuesday afternoon, users in Michigan reported via social media that they were unable to place sports bets on the Kalshi app.
In a statement to Decrypt, a Kalshi representative indicated their disagreement with the state's decision and their intention to contest it in court, while also implementing necessary restrictions in the interim.
Michigan Attorney General Dana Nessel expressed satisfaction with the court's ruling and reiterated her commitment to challenging Kalshi and other prediction market platforms active in the state. She stated, “We remain committed to enforcing a level playing field for all gambling platforms in Michigan and ensuring that companies cannot evade accountability or exploit consumers under the guise of a prediction market.”
Previously, Kalshi faced similar temporary bans in Nevada and Massachusetts. The ongoing regulatory battle surrounding prediction markets continues to unfold across various state and federal courts, with potential resolution from the U.S. Supreme Court on the horizon.
