Judge Denies Motion to Vacate Settlement
A U.S. District Judge has upheld a $5 million settlement between Gemini and the Commodity Futures Trading Commission (CFTC), rejecting a rare joint request from both parties to annul the agreement.
In a ruling issued on October 15, Judge Alvin Hellerstein of the Southern District of New York stated that changes in the CFTC’s enforcement priorities and allegations of misconduct within the agency did not provide sufficient grounds to vacate the settlement reached in January 2025.
Gemini, founded by the Winklevoss twins, had entered into the settlement following charges from the CFTC regarding false statements made in connection with a proposed Bitcoin futures product back in 2022. Despite the CFTC's recent shift towards a more accommodating posture towards the crypto industry, the judge's decision maintains a permanent injunction against Gemini, prohibiting the exchange from making misleading statements to the agency.
