Devin Kim, a former engineer at xAI, has filed a lawsuit against xAI and SpaceX this week, asserting that he was terminated after consistently alerting executives about safety hazards linked to Grok, the company's main chatbot.

In his complaint submitted to the Superior Court of Santa Clara County in California, Kim states that he was let go after persistently advocating for improved safeguards against misinformation, bias, and hazardous outputs, including content that could enable bioterrorism. He contends that insufficient testing has rendered the AI model susceptible to racial and political bias.

Qiaojing Ella Zheng, a partner at Sanford Heisler Sharp McKnight and Kim's lead attorney, remarked, “This case transcends the termination of one employee. It questions whether those involved in developing powerful AI technologies can express safety concerns without jeopardizing their careers. Companies must be held accountable when they penalize employees like Mr. Kim for addressing issues that could have serious public implications.”

The lawsuit describes Kim as one of the initial employees of xAI and a prominent advocate for AI safety, who was drawn to the company partly due to Musk's historical warnings about the potential dangers of advanced AI.

According to the suit, “Mr. Kim transformed his lifelong passion for science and programming into a career in the burgeoning AI sector. Throughout this journey, he witnessed the potential harms of AI when developed without adequate safeguards and dedicated himself to protecting users and the public from such risks.”

The complaint also references various incidents involving Grok that, according to Kim's attorneys, exemplify the dangers he raised internally. These include the chatbot's "MechaHitler" incident last summer, during which Grok produced a series of antisemitic remarks, leading to public outcry and prompting xAI to implement a fix.

Additionally, Kim's lawyers point to ongoing investigations and lawsuits related to Grok's purported creation of nonconsensual sexual deepfakes, including cases in Baltimore and California, concerning the generation of sexualized images of minors.

Kim's attorneys assert that xAI's actions in “retaliating against and wrongfully terminating” him violated the California Labor Code, public policy, common law, and California’s Unfair Competition Law.

This lawsuit follows other significant controversies surrounding AI safety and accountability, including allegations by former OpenAI researcher Suchir Balaji, who accused OpenAI of improperly utilizing copyrighted material for its training data prior to his death in 2024.

While the focus of Kim’s complaint is on Grok and the safety practices at xAI, SpaceX is also a named defendant, coinciding with the company's preparations for a highly anticipated IPO following Musk's decision to integrate xAI and X into the firm.

David Sanford, chairman and co-founder of Sanford Heisler Sharp McKnight, stated, “This case does not oppose innovation. Both Devin Kim and Elon Musk have publicly expressed a core concern that advanced AI must be developed safely and responsibly due to its far-reaching consequences for humanity.”

Kim asserts that his dismissal resulted in significant losses in equity compensation and is seeking the restoration of forfeited equity, along with compensatory and punitive damages, legal fees, and other forms of relief. Earlier this month, he was appointed as the new president of the Center for AI Safety, a nonprofit organization.

“Whistleblowers like Devin Kim are vital in exposing corporate misconduct, and the law safeguards employees who raise such issues,” Sanford remarked.
